अगर किसी व्यक्ति को किसी non-bailable offence में arrest की reasonable apprehension है, तो BNSS, 2023 की Section 482 के तहत High Court या Court of Session से anticipatory bail की direction मांगी जा सकती है.
Patna High Court में matter तैयार करते समय सामान्यतः इन बातों का careful examination जरूरी होता है:
- FIR और लगाए गए offences
- Applicant का specific role
- Allegations और available material
- Previous criminal antecedents
- Custodial interrogation की आवश्यकता
- Investigation की stage
- Applicant की cooperation
- Appropriate bail conditions
Anticipatory bail automatic right नहीं है. Court facts and circumstances के आधार पर judicial discretion exercise करती है.
