Article 226 of the Constitution empowers High Courts to issue appropriate writs, directions and orders to persons or authorities, including Government authorities, within their jurisdiction.
लेकिन हर grievance automatically writ matter नहीं बन जाता।
Writ jurisdiction may become relevant in matters involving, depending on facts:
- Violation of fundamental/legal rights
- Arbitrary administrative action
- Failure of statutory duty
- Unlawful orders
- Jurisdictional errors
- Issues requiring judicial review
The availability of an alternative statutory remedy is also an important consideration, although it is not an absolute bar in every situation.
A writ petition should be based on a clear legal issue, not merely dissatisfaction with an administrative decision.
